Man Who Punched 5-Day-Old Baby In The Face Tells Court He Thought She Was A Toy.
A MAN who punched a newborn baby in the face has insisted that he thought the infant was a doll – but admitted that his actions were “bizarre”.
David Hardy approached five-day-old Elsie Temple as she lay in her carry cot inside a shopping trolley, thumping her as the baby’s mother Amy Duckers looked on in horror.
The 63-year-old man, from Baguley, Greater Manchester, left the baby Elsie Temple in tears and with a red mark to her face.
Hardy yesterday faced court, keeping his head down as his lawyer Chris Fallows tried to defend his client, telling the Manchester magistrates court: “This is an extremely unusual case.
“This defendant (is) effectively a family man who has young children in the family and does not behave in a way that is suggested to this allegation.”
Mr Fallows said: “The crown suggest Mr Hardy deliberately punched a five day old baby to the face in a carry cot in a shopping trolley. The defendant says he believed – and this belief was prior to the incident – that he thought it was a doll.”
He said that the man’s claims that he thought the baby was a doll was backed up by statements given by witnesses to the incident with the man also claiming he told the young child standing next to the shopping trolley.
Mr Fallows said: “After the incident the defendant, who has never been in trouble before, had news reporters arrive at his door. He was hung, drawn and quartered on social media and in the comments on news reports.
“It is conceded by the defendant that what occurred was unusual, bizarre and he acted rather foolishly. The prosecution suggest that this was intentional.”
The court date had been moved forward to today, the eve of Hardy’s 64th birthday, at the request of his lawyers.
Mr Fallows said: “This defendant has been on the verge of suicide and his family will have to go through evidence which is already in their statements. I asked for this case to be moved forwards because Mr Hardy wants it dealt with as quickly as possible.”
Hardy has admitted to throwing the punch but pleaded not guilty to charge of common assault saying he had no intention of hitting a baby. He will face a trial at the JPs court next month.
The baby’s family had been shopping for their dinner about 6pm on September, with the incident unfolding when they saw a neighbour who worked there.
The neighbour called over a friend who had been shopping with her husband – and as she did so the man rushed over and punched Elsie in the face.
Hardy was bailed on condition he does not go to Tescos in Baguley and was told he cannot have unsupervised contact with children under the age of 18. He also cannot contact Elsie’s mother and father.

Revealed: Suspect in two Texas killings and a kidnapping is an illegal Mexican immigrant who had already been deported THREE times.
A man accused of killing two strangers in Texas and kidnapping a third was living in the US illegally and had been deported three times back to Mexico, immigration officials revealed on Wednesday.
Meanwhile, Dallas County jail officials discovered the suspect initially identified as Silvestre Franco-Luviano was using one of his eight aliases.
The 40-year-old suspect's true identity is Juan Navarro Rios, said Dallas County sheriff's spokeswoman Melinda Urbina.
This jail booking photo provided by the Dallas County Sheriff's Department shows Juan Navarro Rios on September 28, 2016. |
Navarro Rios is suspected of shooting Ruben Moreno in his car in southeastern Dallas and Welton Betts at a gas station in the Dallas suburb of Cedar Hill. |
Standoff ends: A SWAT team apprehended Navarro Rios outside an apartment complex in suburban Dallas Tuesday evening. |
The false identity was discovered as Navarro Rios was being booked into the Dallas County jail after his transfer from the Williamson County Jail in Georgetown.
He is accused of gunning down 23-year-old motorist Ruben Moreno in Dallas and 44-year-old Welton Betts at a gas station in nearby Cedar Hill in the course of a two-day rampage. Police have not released a motive for either killing, both of which occurred on Sunday night.
Criminal records had identified Navarro Rios over the years by some variation of Silvestre Franco-Luviano.
He was initially deported in June 1996 for a felony conviction, US Immigration and Customs Enforcement spokesman Carl Rusnok said Wednesday.
ICE declined to say what the felony conviction was, but court records show the Mexican national had a 1995 assault conviction in Dallas and a 1996 conviction for hindering prosecution.

Moreno was sitting in his Hummer (pictured) when he was shot to death during the crime spree. |
Navarro Rios illegally returned to the US some time later and was again deported in October 2009 for re-entering by falsely claiming US citizenship, Rusnok said.
He again came back into the US and was prosecuted on vehicle burglary charges in Georgetown, Texas, in 2010 and 2011. He was deported in March 2014 after completing an eight-month prison sentence for re-entry after deportation, according to a statement Wednesday from ICE.
Documents obtained by Fox 4 News indicate that the illegal immigrant used a fake passport to travel between Mexico and the US 35 times.
Navarro Rios was arrested Tuesday after a standoff with the Lone Star Fugitive Task Force at his relatives' apartment in Georgetown, about 25 miles north of Austin, according to police.
Second crime scene: Welton Betts was pumping gas at this Texaco gas station when Navarro Rios allegedly shot him. |
The suspect allegedly carjacked Bett's vehicle after forcing his wife, Gail (right), out of the passenger seat at gunpoint. |
Austin-based writer Chris Walker posted video clips of the dramatic takedown, in which stun grenades were used, and tweeted: 'Suspect started fire and kicked hole through wall of adjoining apartment.'
He was transferred Wednesday from the Williamson County jail to the Dallas County jail after his arrest on a murder warrant in the death of Ruben Moreno, who was sitting in his Hummer when he was shot.
He's also a suspect in the carjacking death of Welton Betts, who was killed at a Texaco gas station in the suburb of Cedar Hill. Police say the gunman then fled in the victim's car after forcing his wife Gail out of the vehicle at gunpoint.
Georgetown Police Chief Wayne Nero said Navarro Rios was also a suspect in the abduction and robbery of a man who was doing landscaping work outside a Georgetown department store on Monday.
Alien: Officials say Navarro Rios, pictured in handcuffs after his arrest, was living in the US illegally and had been deported three times back to Mexico. |
The victim of the kidnapping was later found unharmed at a gas station a mile away.
At 5pm on Tuesday, police got a tip that Navarro Rios was holed up in his sister's apartment in Georgetown and sent in a SWAT team to apprehend him.
According to authorities, the fugitive set fire to his sister's home and broke through a wall to the unit next door. He was tackled and arrested as he ran out of the Parkview Place Apartments at around 7.30pm.
Navarro Rios is being held in Dallas County jail on $250,000 bond. ICE placed an immigration detainer on the suspect immediately after his arrest, meaning the agency is asking that he not be released.
Woman with facial deformity so severe she couldn't EAT without hurting herself has life-changing surgery to reduce painful growth.
A woman whose facial growth became so enlarged that she would chew on her own skin while she ate has finally had the life changing surgery she dreamed of.
Starrina, from Arizona, appeared on last night's Botched By Nature where she hoped doctors would be able to help with her facial deformity.
After meeting their patient Doctors Paul Nassif and Terry Dubrow Starrina reveals that her that a previous doctor diagnosed her with a hemangioma.
Starrina had lived with her uncomfortable facial growth for decades which caused her to chew on her own skin while she ate. Pictured: Starrina before surgery. |
After surgery. |
However, the medical experts reveal some shocking news that in fact she has been misdiagnosed for 30 years.
After appearing on Botched By Nature, Starrina has finally had the life changing surgery she needed to reduce her painful growth.
Upon examining Starrina, we can safely say that this is a misdiagnosis,' Dr Nassif says.He then explains that a hemangioma gets smaller as a person gets older and in Starrina's case, it has gotten larger, adding: 'This is a vascular malformation, blood just sits in there in pools.'
After correctly diagnosing her the doctors explained that the process of making her growth smaller would be done in two stages.
The first stage is embolization, where they inject foam into her growth to shrink up the blood vessels inside.
The second stage is surgery where the doctors will operate on the growth to try to make it smaller.
The doctors say that this is especially clear as a hemangioma gets smaller as a person gets older and in Starrina's case, it has gotten larger.

The dotors explain that surgery will be risky but Starrina is keen to go through with it.
After having the embolization, it's time for Starrina to have surgery. Dr Nassif explains that the operation comes with a risk.
He says: ' This is something that's very difficult there's a risk of injuring one of those nerves, bleeding, more scar formation.
'Not that anything we do is simple but in Starrina's case is exceptionally difficult and risky. We're really not going to know what's going on until we get in there.'
For the complicated surgery (pictured) Dr. Nassif brings in Dr. Greg Levitin, a 'super specialist' on vascular malformations. |
However, Starrina is keen to try anything to try and reduce her growth. She says: 'It feels like my whole life I've waited for this opportunity and I'm just excited for the furture'.
In order to give Starrina the best outcome possible, Dr. Nassif brings in Dr. Greg Levitin, a 'super specialist' on vascular malformations.
For Starrina's surgery, Dr. Nassif explains: 'We are going to start by removing a triangular piece of tissue from her lower lip.
Next we will make incisions inside her mouth and begin conservatively removing as much of the abnormal mass as possible.
Starrina and her partner (pictured) are now looking forward to a bright future together. |
Dr Nassif says: 'We took Starrina and improved her, it's not a two-month process when you try to cure something that has been accruing over 30 years.'

Siberian youth hangs over balcony to impress girl, falls 23 floors onto car — and lives.
A story of miraculous luck comes from the Siberian Times, which reported this week that one Alexander Shadrin, 16, fell some 230 feet onto the roof of a Renault and survived.
Had it been a sturdier vehicle, perhaps, or had he missed the car by a few inches, the outcome could have been far more tragic.
According to the paper, witnesses said the young man was trying “to impress a girl” by climbing over a balcony and hanging on to a railing in the city of Novosibirsk.
But he lost his grip and plummeted 23 floors.
Photographs show a badly damaged Renault Logan taxi, fortunately unoccupied, which was credited with saving his life.
He was reportedly conscious after the fall and said to be in stable condition at a hospital.
“The identities of the girl he was seeking to impress, and his relatives have not been made public,” said the Times.
“He has a bruised abdomen and lung, a tear in his liver and a broken shoulder. The guy was born under a lucky star. He is stable and conscious,” a Novosibirsk investigator, Anastasiya Kuleshova, told TASS.

Trevor Noah doesn’t care if he’s ‘making too many black jokes’.
It’s no secret that when SA-born comedian Trevor Noah took over the helm of the Daily Show from Jon Stewart a year ago not everyone supported the move.
Trevor was a ‘relatively unknown’ comedian from SA who represented a dawn of change for the show.
So it is not unusual that the comedian has received a fair amount of criticism as viewers get comfortable with his style of comedy.
Trevor‚ who celebrates one year on the show this week‚ spoke to US publication Vice about his journey this far.
During the interview Trevor opened up about the backlash he’s gotten and how he’s handled it.
“I always say‚ ‘It’s like I was playing in high school or college sports‚ and this is major league.’ You can prepare all you want‚ but you’re now in a completely different league with different criticisms‚ different competition‚ and different objectives. It changes everything‚’” he said.
Trevor said that when he joined the show one of the things on top of his agenda was to introduce a level of “multiculturalism.”
The comedian says that whenever he’s been questioned about ‘jokes being too black’ he has this response.
“I think the biggest thing was just trying to bring in a level of multiculturalism. The one thing I acknowledged when I got here was that the show was very white. And not in a negative way. It just was what it was‚” he said.
Trevor added that when someone questioned him about jokes being ‘too black‚’ he responded with a rhetorical reply‚ questioning what a ‘black joke was.’
The comedian added that when people complain that his show focuses too much on a single topic‚ especially when its an issued like Black Lives Matter‚ he just sits back in disbelief.
“That is the level that you have in your mind? Hearing about Trump 100 times is as irritating to you as hearing about police brutality six times? Wow. That’s a problem‚” he said.
Trevor is also set to release his highly-anticipated book Born A Crime on November 15‚ which delves into Trevor’s childhood of a mixed-race child growing up during the Apartheid regime.
Melania Trump’s $2,645 Presidential Debate Dress Sells Out — Plus, See Who’s Worn It Before!.
Melania Trump walks on stage at the end of the first presidential debate at Hofstra University in Hempstead, NY, on Sept. 26, 2016. |
Nothing like a classic LBD. Melania Trump’s simple yet chic black dress from the first 2016 presidential debate on Monday, September 26, has already sold out.
The black off-the-shoulder stretch-knit Roland Mouret dress goes for a cool $2,645.
Trump isn’t the first to wear the classic look. Heidi Klum rocked the garment for an appearance on Good Morning America in July. The model and America’s Got Talent judge, 43, opted to pair the LBD with hoop earrings; Melania, 46, let the dress do the talking Monday night.
Melania, who is married to Republican presidential nominee Donald Trump, has been in a who-wore-it-better situation before.
During the Republican National Convention in July — where Melania was accused of plagiarizing Michelle Obama’s 2008 DNC speech — the former model wore a white Roksanda Ilincic bell-sleeve dress that retails for $2,190.
The dress sold out hours after Melania’s RNC appearance, but Joyce Beatty, a Democratic congresswoman from Ohio, appeared at the Democratic National Convention a week later in a very similar frock.

Two largest hospitals in rebel-held Aleppo bombed in 'deliberate' attack as 140 people are killed in just ONE WEEK – as Pope says those responsible 'will have to answer before God.
WARNING: GRAPHIC IMAGES
An air strike and artillery fire hit the two largest hospitals in rebel-held parts of Syria's Aleppo on Wednesday, in what rights groups said was a deliberate strategy of targeting civilian infrastructure.
The two hospitals were struck just before dawn, with the M10 facility hit in an air strike and the M2 facility hit with artillery fire, said Adham Sahloul of the Syrian American Medical Society (SAMS), which supports both hospitals.
The attacks put both facilities temporarily out of commission and left only six hospitals operational in the eastern parts of the city, Sahloul said, calling the attacks 'deliberate'. It was unclear who had carried out the bombings.
'I am in the M2 hospital now. I was inside when the entrance to the emergency room was hit. Three of my colleagues were hurt,' said Aref al-Aref, a medical assistant trapped inside.
A wounded Syrian child is rushed into a hospital after she was hit by mortar shells that targeted Aleppo's government controlled Aziziyah and Suleimaniyah neighbourhoods on Thursday. |
140 people, nearly all civilians, have been killed since late Thursday
'Everyone is terrified and scared today. We are afraid that we will be today's victims,' he told AFP.
President Bashar al-Assad's forces and his ally Moscow have carried out a barrage of air strikes on opposition-controlled eastern Aleppo since Syria's regime announced a bid last week to retake all of the divided city.

Amber Pasztor, 29, has been charged with two preliminary counts of murder in the deaths of her daughter Liliana Hernandez, seven, and six-year-old son Rene Pasztor.
An Amber Alert had been issued for the children in Fort Wayne Monday, saying they were 'believed to be in extreme danger.'
Five hours later, the brother and sister were found dead 70 miles away in Elkhart, Indiana, inside a car belonging to Pastorz's neighbor who was shot to death.
An autopsy Tuesday determined Liliana and Rene died of asphyxiation, Elkhart police Sgt. Chris Snyder said.

Speaking to People Magazine Tuesday, Amber Pasztor's mother, Leanna Pastorz, said she was not surprised to learn of the charges against her daughter, whom she labeled 'evil.'
'We thought she was crazy,' Leanne Pasztor said of her 29-year-old daughter, who had lost custody of her two children more than a year ago due to drug addiction. 'I think her thought was, "If she can't have them, nobody can."'
Liliana and Rene, who according to their grandmother were scared of their mother, moved in with another relative, Emily Lasko Green, and were apparently happy in their new home.
Green told the website that she had gone through 'hell' to gain custody of the brother and sister, whom she described as 'wonderful.'
'They were our babies,' Green said. 'God gave us babies and she took them away.'
Elkhart County Prosecutor Curtis Hill said at a news conference Tuesday afternoon that he expected to formally charge Amber Pasztor in the deaths of the children later this week.
'It's a senseless tragedy,' Hill said.
Pastorz was due in court for a probable cause hearing Wednesday afternoon.
The body of 65-year-old Frank Macomber was found early Tuesday morning by an FBI agent searching the area near the home where the two children were abducted.
Macomber's daughter says he was neighbors with Pasztor, who used to make him drive her around. When his photo was released in the Amber Alert on Monday, his daughter feared that he was being used against his will.
A prosecutor said Macomber probably died before the children were abducted.
After Pasztor's arrest, police continued to search for Macomber. They tried his home, but had no luck, and then focused on the area around the home where the kids' were abducted.
Canadian-based Nigerian doctor suspended for inappropriate sexual behaviors.
Adekunle Williams Owolabi, a Nigerian medical doctor practising in Canada, has been suspended for inappropriate behavior.
Owolabi was found guilty of professional misconduct after four female patients accused him of making sexual comments and inappropriate kissing and hugging.
While carrying out a pap test, the physician asked a female patient if her preference was “big ones or small ones”.
Elizabeth Mate, the doctor who led the disciplinary tribunal, said his comments were “cavalier and unprofessional”.
Huffington Post reports that in a six-day hearing carried out earlier this year, the doctor who graduated in 2000, denied any wrongdoing.
However, in each of the four complaints Owolabi was found to have shown a lack of respect for his patients.
Ruth Trask, a lawyer representing the college, suggested that Owolabi engaged in a pattern of behaivour and argued for an eight-month suspension with strong reprimand.
Owolabi has 30 days to lodge an appeal with the trial division of the supreme court of Newfoundland and Labrador.
Asides being suspended for six months, the Nigeria-trained doctor must undergo training on doctor-patient boundaries and pay 75,000 dollars for hearing costs.
When he resumes work, Owolabi must have a chaperone with him while seeing female patients for two years.
Adele's comeback album 25 hits diamond status after selling 10m copies in the US in less than a year.
She must have called her ex boyfriend 1,000 times.
But that's nothing compared to the number of albums Adele has sold.
The 28-year-old's comeback album 25 has reached diamond status by selling 10 million copies in less than a year.
Rolling deep: Adele celebrated her album 25 reaching diamond status after selling 10m copies on Tuesday.

The record was released last November and features the hits Hello and Send My Love (To My New Lover).
Israeli's Ex President Shimon Peres Dies Aged 93.
He suffered a stroke two weeks ago and his condition improved before a sudden deterioration on Tuesday.
Mr Peres, who was one of the last of a generation of Israeli politicians present at the new nation's birth in 1948, served twice as the country's prime minister and once as president.
He won the Nobel Peace prize in 1994 for his role negotiating peace accords with the Palestinians a year earlier.
He once said the Palestinians were Israel's "closest neighbours" and might become its "closest friends".
Mr Peres shared his Nobel Peace Prize with Prime Minister Yitzhak Rabin, who was later assassinated, and Palestinian leader Yasser Arafat.
At the start of his long political career, he was put in charge of personnel and arms purchases for the Haganah, the predecessor of the Israel Defense Forces.
He secured a deal with France to supply the new Israeli nation with Mirage jet fighters. He also set up Israel's secret nuclear facility.
Once an advocate of Jewish settlements in the occupied West Bank, Peres later became a leading political dove. He often spoke of the need for compromise over territorial demands in Palestinian areas.
He maintained an active public schedule into old age, mostly through his non-governmental Peres Centre for Peace, which promotes closer ties between Israel and the Palestinians.
He retired from his role as president in 2014.
Clinton, Trump clash in first debate: CNN's Reality Check Team vets the claims.
(CNN)Hillary Clinton and Donald Trump clashed Monday in their first head-to-head debate of the general election season, with Trump in particular straying from the truth, CNN's Reality Check Team found.
The team of reporters, researchers and editors across CNN listened throughout the debate and selected key statements from both candidates, rating them true; mostly true; true, but misleading; false; or it's complicated.
By Laura Koran, CNN; Clinton claimed Trump "thinks that climate change is a hoax perpetrated by the Chinese," a charge Trump immediately denied. Who's telling the truth?
On November 6, 2012, Trump tweeted, "The concept of global warming was created by and for the Chinese in order to make U.S. manufacturing non-competitive."
Over a year later, Trump tweeted in response to weather reports, "Snowing in Texas and Louisiana, record setting freezing temperatures throughout the country and beyond. Global warming is an expensive hoax!"
And Trump's doubts have continued into the campaign season.
Last September, when he was seeking the Republican nomination, Trump told CNN that while he supports clean air and water, "I am not a believer in climate change."

And Trump's doubts have continued into the campaign season.
Last September, when he was seeking the Republican nomination, Trump told CNN that while he supports clean air and water, "I am not a believer in climate change."
Trump went on to refute the connection between climate change and a rise in extreme weather phenomenon.
"Weather changes," Trump said. "And you have storms, and you have rain, and you have beautiful days, but I do not believe that we should imperil the companies within our country. And by the way, China is doing nothing."
In March, Trump took a more nuanced approach, telling a Washington Post editorial board that he doesn't believe climate change is the result of man-made causes.
"I think there's a change in weather," he said. "I am not a great believer in man-made climate change. I'm not a great believer."
And while Trump has repeated the hoax line on multiple occasions, he's walked back the assertion that it was created by the Chinese, saying he meant that as a joke ... sort of.
"I often joke that this is done for the benefit of China," Trump said on Fox News' "Fox & Friends." "Obviously, I joke, but this is done for the benefit of China, because China does not do anything to help climate change."
While Trump doubts the validity of climate change, his company has prepared for it. According to a Politico report, Trump International Golf Links applied for a permit to build a sea wall at his golf course in Ireland to protect it from "global warming and its effects."
Our verdict: True. While Trump has wavered on the cause of climate change, he has repeatedly denied its existence and called it a hoax.
