British songwriter who wrote Michael Jackson's Thriller dies of cancer at 66.

The British songwriter who penned Michael Jackson's hits Thriller and Rock With You has died aged 66.

Rod Temperton died in London following a 'brief but aggressive battle with cancer, his music publisher announced.

Known to industry insiders as the 'Invisible Man', Temperton was also behind classics including George Benson's Give Me The Night and Heatwave's Boogie Nights.

Jon Platt, chairman and chief executive of Warner/Chappell, said in a statement: 'Rod Temperton, British composer and musician, died last week at the age of 66 in London following a brief aggressive battle with cancer.

'His funeral was private.'

He added: 'He was often referred to as the Invisible Man. He was the sole writer of multiple successful songs such as Thriller, Off The Wall, Rock With You, Give Me The Night, Sweet Freedom, Always & Forever and Boogie Nights, to name just a few.

'His family is devastated and request total privacy at this, the saddest of sad times.'

The songwriter was behind Michael Jackson's hit songs Thriller and Rock With You. 


Temperton began his career as a member of the disco band Heatwave, penning the 1970s hits Always And Forever and Boogie Nights for the group.

He collaborated with the likes of Anita Baker, George Benson, Herbie Hancock, Aretha Franklin and the Brothers Johnson.

But he was best known for writing songs for Jackson's albums Off The Wall and Thriller, after working with the singer's producer Quincy Jones.

Investigators in Paris are now trying to track down the gang responsible for holding Kim Kardashian at gun point at her luxury apartment and stealing £8.5million worth of jewellery.

But mystery surrounds who was responsible for the raid or how the armed gang even managed to make it into the reality TV star's apartment.

They struck at 2.30am on Monday, just hours after Kim wore her £3.5million engagement ring, given to her by rapper husband Kanye West, for only the second time on Snapchat.

Here MailOnline poses 10 unanswered questions that remain following the heist in the French capital while martial arts guru Matt Fiddes, the former bodyguard of Michael Jackson, gives his view on the robbery:

1. Why were Kim Kardashian and her best friend, the stylist Simone Harouche, by themselves in an unguarded flat with at least £8.5m worth of jewellery that Kim has pictured on social media? Family and other aides were staying less than a mile away at the Four Seasons George V Hotel.

He Fiddes told MailOnline that there was never an occasion when he was looking after Michael Jackson that he would be left completely alone.

He said: 'Michael used to tell me that he had never walked down the street alone without security since he was seven years old.

'She should have absolutely not have been left alone without security, it is all very fishy.

Kim and her best friend, the stylist Simone Harouche, were left by themselves in an apartment in Paris before the raid. 


'When you are carrying expensive jewellery such as that, it is not unusual for the jewellery itself to have its own bodyguard.

'It's a different world now with social media and by showing off your wealth you are becoming a target.'


2. Why was there no CCTV whatsoever inside or directly outside the palatial apartment block – where flats rent for up to £8,000 a week? Such cameras not only detect the approach of criminals, but also deter them.

Mr Fiddes says that a celebrity on Kim Kardashian's level should have had security cameras fitted not only outside the building but inside too.

He explained: 'A camera should have been fitted to the bedroom door where she was sleeping along with a sensor.

'A screen could have been set up in the chief of security's bedroom, and somebody would have watched it all night.

'It is standard procedure. There is something not right there.'


3.Why was only one night porter on duty in a block used to house some of the biggest stars in the world, including Madonna and Leonardo di Caprio? The block provides cooks, chauffers and other staff, so why not a 24/7 dedicated security team?. 

Mr Fiddes said it seems unusual that Kim's own security did not stay with her at the apartment.

It has since been revealed that there were no CCTV cameras either inside or directly outside the luxury apartment, above, where Kim was staying with £8.5million worth of jewels. 

He added: 'It is normal for celebrities on her level to bring your own security team.

'I would have said she should have had seven or eight security people on the ouside of the building and another two or three more trusted people inside.

'In America, when I was with Michael Jackson we would also have a link to local police and they would come right away if there was an incident.'

4. How did the gang get through a deadlocked armoured door that was also bolted from the inside? There was no sign of forced entry, and no reason whatsoever why anybody would have allowed unidentified men entry in the middle of the night. Even if they were falsely claiming to be police, a simple telephone call could have alerted bona fide officers.

Mr Fiddes said it would be normal for security teams to do a sweep of the building before there client would get there.

He explained: 'A high level celebrity would bring their own security team do to a complete sweep of the building.

'They would normally go to a place a day or two before the celebrity to a reccy and check out everything where their client would be.'

5. What information would the porter – who was tied up and gagged – have had about Ms Kardashian's whereabouts, movements, and personal security arrangements? It is standard policy in VIP portered blocks for residents to have absolute privacy, and not to divulge any information to what would amount to very junior and low paid staff members.

Mr Fiddes says that it is difficult to keep a celebrity's movements under wraps, especially when they are high profile.

But he added: 'You have people like maids and concierge in hotels, they will tell people who is staying there.

'Usually they will want autographs and the celebrity will oblige but that is why celebrities will bring their own security.'


6. Why did Ms Kardashian's bodyguard, Pascal Duvier, leave her alone to go to a nightclub? And how – apparently – did the gang know he was not there?

Mr Fiddes said that it is beyond belief that Mr Duvier was not with Kim, and instead was with her sister Kourtney at a nightclub.

He explained: 'My take on that is that you have to be willing to take a bullet to protect people and when you get to the stage you can't, that is when you have to move on.

'That was part of the reason why I left my job with MJ (Michael Jackson) because I had children.

'It seems that he has become more of a friend to Kim rather than an employee, you can see that when the prankster tried to grab her a few days earlier.

'He also has his own social media accounts, which we would not have been allowed to do at all.

When I worked for Michael, we weren't even allowed to tell our wives or girlfriends where in the world we were.'



7. Why was Ms Kardashian allowed to leave France within a few hours of the crime, so as to return to the USA? 

It is common procedure for victims of serious crime to assist police and prosecutors with enquires for at least a few days afterwards. Key information could easily be forgotten if and when Ms Kardashian ever returns to Paris to speak to police again.

Just hours after the raid, Kim fled France and boarded a private jet headed for New York.


8. Why were only three bodyguards protecting members of the Kardashian clan in France during the country's ongoing State of Emergency, which was imposed following terrorist attacks in Paris? Kim Kardashian was meant to be in her own flat with one bodyguard, while the other two security men were with other family members at the George V.

Mr Fiddes said Kim may have been badly advised to go to Paris for fashion week given the current state of emergency in France.

He explained: 'When her security were doing their research, they would see Paris has had two major terror attacks recently.

'She is one of the most high profile celebrities in the world and I might have advised her not to go, especially if it was just to attend some fashion shows.

'She is a major target, especially as she an high profile American woman.

'There were times with Michael when he really wanted to visit places but they were just too dangerous.

'We had to tell him, look we can't go there, it is too dangerous.'


9. How did five assailants manage to get in and out of the building, and then away on bicycles? The men apparently escaped with nobody seeing them at all apart from their principal victims, Ms Kardashian and the unidentified porter.

Mr Fiddes says that in his previous role, Michael Jackson had a videographer who would document his every move.

He explained: 'We would do this to protect his safety and the safety of the people around him.

'It meant you could identify people who were constantly following him and we could review the footage.

'One of the reasons was may be if a fan said MJ's car ran over their foot and they wanted to sue us, we could look back and stop a lawsuit dead in the water.

'We used to use camcorders back then, but it is easy now to use dashcams or cameras you can wear.'


10. There have been a spate of 'home jackings' – French slang for robberies in private residences – in the district where Ms Kardashian lives in Paris, so why wasn't she warned, and better protected.

 Mr Fiddes says that security teams would usually do their research into the place their client was staying.

He said: 'You would get yor security to do a reccy beforehand and expect them to look into the history of the area.

'Then they can then plan accordingly. It is not Kim's fault. She seems to have been badly advised.'

A Housekeeper Who Absconded With Employer’s N3million Jewelry Charged To Court.



A housekeeper, Bose Vitawan, who allegedly absconded with her employer’s jewelry valued at N3m was on Tuesday brought before an Ebute Meta Chief Magistrates’ Court in Lagos.

The accused, 24, is being tried on two counts of conspiracy and stealing to which she pleaded innocence.

The Prosecutor, Insp. Daniel Ighodalo, said the accused with others at large committed the offences on September 2 at No. 307, Banana Island, Lagos.
He alleged that the accused fled with 18 pieces of gold watches, 15 pieces of gold rings, 10 sets of gold necklace and earrings and 10 costume beads, all valued at N3 million belonging to her employer.

The offences, he noted, contravened Sections 285 and 409 of the Criminal Law of Lagos State 2011.
The Chief Magistrate, Abimbola Awogboro, admitted her to a bail of N200,000 with two sureties in like sum.
Section 285 prescribes a three-year jail term, while Section 409 provides two years for offenders.
Further hearing has been fixed for November 9.

Biographer relives talks with Boko Haram
President ‘didn’t foil 1985 coup despite hint’
Boko Haram demanded from the Federal Government €5billion (about N1,706,850,000,000) to free 219 Chibok girls . The Euro exchanged for approximately N341.37 last night.

President Muhammadu Buhari allegedly got wind of the August 27, 1985 coup d’état against him as a military Head of State but he did not foil it to avoid executing some senior Army officers.

These facts are contained in the book, “Muhammadu Buhari: The challenges of leadership in Nigeria”, authored by Prof. John Paden.
The book, which was presented to the public on Monday at the International Conference Centre in Abuja, contained some unknown issues about the President.

But the insider’s account on the botched negotiation between Boko Haram and the Federal Government provided fresh insights into the plight of the Chibok girls.
Some excerpts from the book are: “An additional issue was the status of the Chibok girls. Secret negotiations had been held regarding an exchange of Boko Haram prisoners for the girls.

“On several occasions, prisoners were taken to Maiduguri to facilitate an exchange. But these negotiations stalled when Boko Haram demanded a ransom of €5billion for the girls.
“The dilemma for the DSS, which was handling the negotiations, was that a military assault to rescue the girls would almost certainly result in their deaths at the hands of their Boko Haram captors.

“But the Nigerian government was not going to accede to Boko Haram’s extra-ordinary demand for a vast sum of money which would no doubt be used to fund future attacks.
“One or two girls were able to escape their captors in May, but the rest remained captive and the impasse continued. 

“The Chibok girls were not alone in their grim fate. Hundreds if not thousands, of persons had been captured by Boko Haram in the North-East. Buhari would need to continue degrading Boko Haram until he could tighten the noose around its Sambisa hideouts and bring a close end to this painful episode.”
On why Buhari placed his ministers on lower salaries and allowances, the author said the President wanted to make ministerial appointment less attractive as a way of curbing corruption in public office.

He went on: “Buhari was trying to eliminate the allure of ministerial appointments as a means of accruing wealth either through receiving a generous salary or through exploiting power for corrupt personal gain.
“Of course, the effort to combat corruption also required creating disincentives for corrupt practices strong enough to dissuade ministers from ‘chopping’ on the side. The penalty if caught would be dismissal and public shaming.”

Concerning the arrest of a former Minister of Petroleum Resources, Mrs. Diezani Alison-Madueke, the author said the ties between the President and ex-Prime Minister David Cameron made it possible.
“Yet the close ties between Buhari and British (former) Prime Minister David Cameron facilitated efforts to launch a coordinated effort to bring money launderers to book, as demonstrated in the role of the London Metropolitan Police in the case of Diezani Alison-Madueke.”

The National Crime Agency (NCA) in the UK arrested and quizzed Mrs Alison-Madueke and four others on October 2, 2015 for alleged bribery and corruption and money laundering.
Also the Economic and Financial Crimes Commission (EFCC) has interrogated between three and five more suspects since Mrs Alison-Madueke’s interrogation by the NCA.

The same NCA had last year obtained permission from a Westminster Magistrate’s Court to seize £27,000 from Mrs Alison-Madueke and two other women.
Regarding the counter-coup of August 27, 1985 which led to Buhari’s removal as a military Head of State and the emergence of ex-President Ibrahim Babangida, the author said the President knew a plot was coming but he did not want to shed blood.

The book reads: “The question has arisen subsequently as to whether Buhari knew about the countercoup in advance.
“Given his ‘appreciation’ of complex situations, it is argued by some, how could he not have known? Some of those closest to Buhari at the time have subsequently argued that he did know a countercoup was coming. 

They insist that Buhari calculated that to preempt this plan would have meant executing six or eight senior officers. This he was unwilling to do.”
The book explained that Buhari was detained after the 1985 coup in Akure and Benin from August 27, 1985 to December 1988.

The book states: “Babangida also tried to look for ways to indict Buhari personally, but his integrity and grassroots popularity helped protect him.
“After the Babangida countercoup, three of the ministers were retained. Babangida also set up the Aboyade probe into the finances of Buhari and some key ministers but the investigators could find no evidence of any personal aggrandisement on his part during his term as Head of State.

“Significantly, the three ministers retained from the previous administration by Babangida-Lukman, Bali and David-West— strongly defended the integrity of Buhari and his close associates, and no charges were ever brought against Buhari.

“Meanwhile, Buhari had been taken from Lagos by plane to Akure in Ondo State. After a few months in Akure, he was taken to Benin City in the south of the country, where he would stay under house arrest until his release in December 1988.”

Newborn baby girl is found abandoned with her umbilical cord still attached in a Chicago field.

James Turner was walking by the field in the Chicago Heights suburbs when he came across the baby girl, who still had her umbilical chord attached.

Police received a 911 call around 11am from Turner who reported that he discovered an 'unattended newborn lying in the grass in an open field', according to WGN TV.

He found the baby along a path used by residents as a shortcut through the field.

Chicago Heights Police Chief Thomas Rogers told WGN TV that detectives are trying to find the baby's family.

He said in his experience children get left behind when a mother is scared and possibly no other family members know about her pregnancy.

Rogers noted that there is a 'safe-haven law' that not many mothers know about.

According to the law, a newborn up to 30 days old can be dropped off at a police station, fire station, or hospital with no questions asked.

Kevin Hart is world highest paid comedian.


Veteran American comedian, Kevin Hart, has emerged world’s highest-paid comedian by earning 87.5 million dollars in one year.

The 37-year-old stand-up comedian and actor topped the list of 10 highest-paid comedians released by Forbes Magazine.


According to Forbes, the rating is based on Hart’s total earning between June 20 15 and June 2016.

The ranking indicated that Hart pushed Jerry Seinfeld, who seemed the insurmountable King of Comedy by topping the highest-paid list since 2006 to second position with 43.5 million dollars earning.

It noted that Seinfeld combined pretax earnings over the last 10 years top 900 million dollars, and year after year, he claimed the top spot on the list of the world’s highest-paid comedians.

Forbes noted that “the reason for Hart’s dominance is simple: He tours like no other comedian.

“In the 12-month period, Hart played over 100 shows with an average gross of over one million dollars at each stop.

“These shows aren’t at dingy comedy clubs; Hart played stadiums and arenas, including Madison Square Garden and the Staples Centre.

“Because the stand-up comedian’s set requires little more than a stool, water bottle and microphone, he takes home a larger cut of that gross than most rock stars would.”

Surprisingly, however, Amy Schumer was the only female comedian on the Forbes list ranked fourth with earnings of 17 million dollars.

Forbes noted that “Schumer is the first woman to ever make the highest-paid comedians list.

“This is because women have historically faced difficulty being taken seriously in the funny business.”

Comic John Bishop, was, however, at the bottom of the list with seven million dollars earning.

The World’s 10 highest paid comedians earned a combined 233.5 million dollars between June 1, 2015, and June 1, 2016, before management fees and taxes.

Their earnings came from touring, endorsements, films, DVD sales, TV specials and paid appearances.

Forbes had earlier in August released the list of 20 world’s highest paid actors and the world’s 10 highest paid actress, where veteran Hollywood superstar, Jennifer Lawrence, topped the list of the highest-paid actress, earning 46 million dollars.

Wrestling superstar turned actor, Dwayne Johnson, also known as ‘The Rock’, topped the list of the highest paid actors with 64.5 million dollars earning.

Atlanta murderer flees courthouse during trial before guilty verdict is delivered and remains at large.

  • He was supposed to wear an ankle monitor but it's unclear whether the device is active.

Police in Georgia are looking for a man after being convicted of murder on Monday managed to walk out of the courtroom - and now he is nowhere to be found.

Taiquan Mitchell, 24, of Atlanta, was out on $125,000 bond in connection with the January 2014 death of 29-year-old Beanite Waters.

After the jury returned its guilty verdict, Mitchell was gone.

'He was found guilty of all charges, but as of now he's a fugitive,' Marcus Garner, spokesman for the district attorney's office told The Atlanta Journal-Constitution.

Mitchell was dressed in a suit meaning he was able to walk straight out the front door without being noticed by security.



Mitchell was originally granted bond in May 2014 with the condition that the murder suspect wear an ankle monitor and be under house arrest with a 7am to 7pm curfew.

It's not known if his ankle monitor is currently operational as Dekalb County police attempt to track the fugitive down.

Mitchell's co-defendant Deon Dorsey was also granted bond but never posted it and has remained in the county jail.

Both defendants were found guilty of various charges, including murder, aggravated assault, possession of a firearm in the commission of a felony and armed robbery.

Prepare for 'Google Magic': Verizon leaks more images of the Pixel phone ahead of its release today.



Google's Pixel smartphone will launch later today - but it seems most of its details have already been revealed.

Thanks to a number of leaks, Android fans have seen the phone from almost every angle.

Now, high definition shots, leaked by US carrier Verizon, show the Pixel face on and side on in blue and silver models.

Pixel is also expected to have 12- and 8-megapixel cameras, full HD AMOLED screen with Gorilla Glass protection, and run on a Snapdragon 821 2.15GHz processor.

Pixel also ships with Android’s Nougat OS.

The leak by the British smartphone retailer follows in the wake of Canadian mobile phone carrier Bell, which also jumped the gun by publishing its page for the new handset.

Google is set to launch the new phones at an event in San Francisco on 4 October at 9am local time (5pm BST or 12 ET). 

The new product name was first mentioned last month.

The new Pixel and Pixel XL handsets are expected to go head-to-head with Apple's iPhone 7 and iPhone 7 Plus.

Driver of train that crashed in Hoboken tells federal agents he has no memory of the accident as it's revealed one on the black boxes is broken.



Driver of the train Thomas Gallagher, 48, is cooperating with investigators from the National Transportation Safety Board.

NTSB official told the press that Gallagher has no recollection of the accident that killed one person and injured 114.

Gallagher says he does remember driving under the speed limit as the train pulled into the Hoboken terminal.

NTSB says that a recording box recovered from the back of the train was not functioning.

Investigators now hope to recover the black box from the front of the train in the hope that it will shed light on how fast the train was going.

The federal agency investigating last Thursday's horrific train accident in Hoboken says that the driver was well-rested before the crash and that he has no recollection of the speed at which the locomotive was going at before it barrelled into the New Jersey terminal.

Bella Dinh-Zarr, the vice chairman of the National Transportation Safety Board, held a news conference on Sunday during which she said that a data recorder recovered from the commuter train was not working.

Fabiola Bittar de Kroon, a 34-year-old mother who was standing at station's platform was killed and 114 others were injured when the No. 1614 Pascack Valley line train that crashed around 8.30am.

It had left Spring Valley, New York at 7.23am and was scheduled to arrive in Hoboken at 8.38am.

The married father-of-two has been working for New Jersey Transit for 29 years.




Passengers said the train never slowed down as it approached the station, crashing at a 'high-rate of speed' into the terminal which tens of thousands of people use to travel into New York City every day.

The driver, Thomas Gallagher, underwent a blood test, which came back negative for drugs and alcohol.

Gallagher, 48, is a married father-of-two who lives in Morris Plains, New Jersey. His father said he has been working in train transportation since he was 19 years old.

Dinn-Zahr told reporters on Sunday that Gallagher said he was well-rested on the morning of the accident but that he has no recollection of what took place immediately before the crash.

The NJ Transit train ran off the end of the track as it was pulling in around 8.45am, smashing through a concrete-and-steel bumper and knocking out pillars, causing the roof to collapse.


Investigators believe that the black box will indicate precisely what speed the train was going when it failed to stop at the Hoboken station.

'We want to get in and get the exact speed of the train,' Dinn-Zahr said. 'We're unable to do that, unfortunately - one of the event data recorders was not functioning.'

'We hope we'll be able to get that. It's unclear right now what the speed was, so we won't know until we actually get that information.'

The authorities are currently removing the wreckage and attendant debris at the site.

A 28 year old UFC fighter is hospitalized in critical condition after he was found unresponsive in Florida home with roommate who died on arrival.



Josh Samman, 28, was found unresponsive on Friday along with roommate Troy Kirkingburg, who was pronounced dead on arrival.

Police have not released any details about the incident, but a ring announcer shared on Facebook that Samman was in a coma.

Kirkingburg, also 28, leaves behind both parents along with his fiancee.

An Ultimate Fighting Championship contender was hospitalized in critical condition while his roommate was pronounced dead on arrival, according to numerous reports.

The MMA community was reeling after news broke that Josh Samman, 28, was still fighting for his life after the death of his roommate Troy Kirkingburg, who worked as a ring announcer,Tallahassee.com reported.

Samman, who made his return to the sport after his leg was nearly amputated at the age of 21, detailed his grief, drug use and suicidal thoughts in a memoir written in the wake of his girlfriend's death in 2013.

According to media sources, UFC bloggers and friends, Samman and Kirkingburg were found in a Hollywood, Florida home early Friday.

UFC officials told MMAWeekly.com they were aware of Samman's hospitalization and in contact with his management team.

Samman, who had been training in Tallahassee earlier this week, was reportedly in a coma with a respirator on, according to a Facebook post written by Christopher Rothstein, a ringside announcer in Tampa.

Police have not released any details about the incident, but friends and fans alike spread their well wishes for the fighter.

The owner of the gym where Samman trained told the Tallahassee Democrat: 'We are just sitting here with held breath hoping for the best and praying. It kind of hit us all right in the teeth.'

'There's not enough good stuff to say about the both of them. [Samman] is a tough guy, he fights through things. We are all hoping he comes through.'

Samman made his professional debut in 2007 and was scheduled for his next fight in Albany, New York in December.

When he was 21, he pulled a muscle and suffered a blood clot in his leg, which swelled dramatically after he got on the plane.

He almost lost his leg and an emergency operation resulted in 200 stitches.

Tragedy struck again in 2013 when his girlfriend Hailey Bevis died in a car crash while the two were texting.

The 28-year-old recounted his grief in the book, The Housekeeper: Love, Death & Prizefighting, which was released earlier this year.

It remains unclear how the 28-year-old Kirkingburg died, but he leaves behind both parents, as well as his fiancee and TV anchor Charlene Cristobal, according to his obituary.

She posted a photograph of them together on Sunday, writing: 'Both of us smiling. Together. That's how I'll remember us. Always. I love you.'

Kirkingburg attended Florida State University and went on to work as a MMA ring announcer around the country.

Incredible drone footage shows Apple's $5billion new Cupertino HQ is almost complete.



Construction on Apple Campus 2 in Cupertino, California, is underway.

It features a huge circular 'spaceship' building covered in solar panels.

There's also a 1,000-seat auditorium and a 100,000 sq ft fitness center.

Construction on Apple Campus 2 – which was announced by late Apple founder Steve Jobs in 2006 and designed by architect Norman Foster – is currently underway in Cupertino, California.

Nearly ten years after Jobs revealed the tech giant had bought the land around a mile from the company’s existing facility at 1 Infinite Loop, his futuristic vision for the new campus is almost realized.

The latest video update from the company revealed that installation of solar panels on the circular ‘spaceship’ building is around 40 per cent complete.

The research and development facility looks almost complete from the outside and multiple office buildings are ‘rising quickly’ on Tantau Avenue.

Meanwhile, construction is also underway on a new 1,000-seat auditorium will be the new home of Apple’s highly-anticipated product reveals.

Sexual offender sues his victim for $4m because she called him a rapist.



Lang Her, 26, is currently serving a one-year jail sentence for the assault of Yee Xiong, who is 24.

As Yee Xiong prepared to leave the sentencing hearing for a man she said sexually assaulted her at an off-campus apartment when they were students, she felt ready to finally put the case behind her after four years. Then, she was handed a $4 million defamation lawsuit.

The lawsuit from Lang Her, who pleaded no contest to felony assault, stated that Xiong and her three of her siblings colluded to alienate him from the close-knit ethnic Hmong community and called him a rapist on Facebook.

Xiong said it was like a 'slap to the face,' what she saw as a way for Lang Her to 'continue to harass my family and me.'

Yee Xiong,24, was about to leave the sentencing hearing for Lang Her, who she said sexually assaulted her when they were student when she was handed a $4 million defamation lawsuit.


According to court documents, Xiong told police she woke in the early hours of July 10, 2012, after a night of drinking in an off-campus apartment, with her arms pinned by Him.She said he was having sexual intercourse with her.

Both were students at the University of California, Davis at the time.

After his semen was found during a rape kit evaluation, He maintained that no penetration occurred, and testified that he believed Xiong wanted to have sex with him.

During the investigation, He's story changed more than once. He went from claiming that nothing had happened on the night in question to saying he and Xiong had kissed but had not had sex.

A number of postings were made on Facebook by Yee Xiong's family who were supporting her during her rape trial, but her assailant is now suing her for libel and defamation as a result.


However, his semen was found inside Xiong. He has continued to deny that any penetration took place, and his attorneys have used Xiong's behavior after the incident – staying at His apartment for the rest of the night and allowing him to give her a ride back to campus in the morning – against her in court.

His attorneys questioned why Xiong stayed the rest of the night in the apartment if she had been raped. 

The lawsuit cites May 21, 2015, as the date the Facebook postings began: The final day of the first criminal trial, when Xiong learned it had ended in a mistrial.

Though Xiong and her siblings were angry and frustrated, she said, they never hatched a plot to ruin his reputation.

A second trial in February 2016 also ended in a hung jury.

The online postings have since been taken down, but in a formal response to the lawsuit stated that the posts were true or believed by the defendants to be true.

The saga has divided their small, tight-knit Hmong community, Xiong said, with members choosing which family to side with and whom to believe.

Eric Rosenberg, an Ohio attorney who has represented clients suing their accusers and universities, said many of the accused suffer damaged reputations and lost educational and career prospects.

'There is no bigger stain on a person in this culture than being labeled as a sexual assailant, and that's what they're labeled as,' said Rosenberg, who has filed or acted as a consultant for more than half a dozen such lawsuits in the past five years.

He said the number of such lawsuits have increased in recent years as the consequences for those accused at schools have intensified. 'They can't get into school, they can't get in to the military, a lawsuit's their only way out,' he said.

Tracking such cases can be difficult, as defamation lawsuits are often filed in state courts and many are settled.

Regardless of the venue, Laura Dunn, executive director of SurvJustice, a nonprofit victim rights group, discourages potential clients from naming perpetrators outside of formal channels.
